GENERAL INFORMATION FOR
FILING ARGENTINE APPLICATIONS
GENERAL REQUIREMENTS
Power
of Attorney, notarized and legalized
(by "Appostille" or by Argentine Consul). In urgent cases
a facsimile copy simply signed by the applicant is acceptable, but to be
confirmed with a formal Power of Attorney within 40
days.
Certified copies of priority
documents in case of claiming priority. This documentation must be filed
within ninety (90) days from the filing date, together with a translation
into Spanish.
TRADEMARKS - SERVICE MARKS
Denomination of the word mark,
and prints of the design if any.
Applicant's full name and address.
Articles, products or services
(or the corresponding International classes) which
the applicant wants to protect.
Serial number and Country in
order to claim priority.
TRADEMARK NOTES:
Previous use
is not required.
Validity: Ten
years, renewable for unlimited consecutive ten-year
terms.
The protection
can be extended to the 45 classes.
The renewal
application can be filed up to 2 months in advance of the deadline. It
is required a continuous use of the trademark (at
least in one class) for the last five years previous
to the date of the renewal application.
Period of time
for claimingpriorities: 6 months.
PATENTS
Applicant's full name, citizenship,
and address.
Inventor's full name, citizenship,
and address.
Date and number of the first
filing of the patent in question, city and country where the application
was filed, or date when the Letter Patent was granted.
Assignment documents if the
original patent was not assigned by the inventor
to the applicant in the country base of the priority.
This documents must be submitted in Spanish within 90
days from the application date.
PATENT NOTES:
Patents are
valid for 20 years counted from the filing date.
Argentina is
not yet a member of the PCT.
Novelty, non-obviousness
and industrial application are basic requirements.
Period of time
for claiming priorities: 12 months.
If no Convention
Priorities claiming, the original patent should not have been published,
put in public use, sold or placed on sale at the
date of filing in Argentina.
INDUSTRIAL MODELS AND DESIGNS
Brief description of the model
or ofthe design, with indication of the title.
Priority documents must be
submitted within 90 days from the application date.
Name, citizenship and address
of the creator.
Gender or kind of product on
which the model or the design will be used or
applied in order to specify the class and sub-class.
Graphic representations of
the model or of the design.
INDUSTRIAL MODEL AND DESIGN NOTES:
Validity:
Five years, renewable for two consecutive 5-year terms.
Period of time
for claiming priorities: 6 months.
Novelty is
a basic requirement.
UTILITY MODELS
Inventor's full name, citizenship,
and address.
Date and number of the first
filing of the utility model in question, city and country where the application was
filed, or date when the Letter Patent was granted.
Certified copy of the specification,
claims and drawings. If the documents are not in Spanish, a translation fee
will be charged.
UTILITY MODEL NOTES:
Utility Models
are valid for 10 years counted from the filing
date.
Argentina is not
yet a member of the PCT.
Novelty, non-obviousness
and industrial application are basic requirements.
Period of time
for claiming priorities: 12 months.

Priority is claiming, the original Utility Model
should not have been published, put in public use, sold or placed on sale
